1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of the website located at cmcustomdesign.com (the “Site”), operated by CM Custom Design (“CM Custom Design,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

You may view and print content from the Site for your own personal, non-commercial reference. You may not reproduce, distribute, modify, publicly display, republish, or create derivative works from any content on the Site without our prior written permission.

Project photographs displayed on the Site depict work completed by CM Custom Design and are shown for portfolio and marketing purposes. Nothing on the Site grants you any license or right to use CM Custom Design’s name, logo, or project imagery for any commercial purpose.

4. No Professional Advice; Not a Proposal

Content on the Site — including service descriptions, the FAQ page, project examples, and general information about renovation, design, or construction — is provided for general informational purposes only. It does not constitute professional advice, a cost estimate, a project proposal, or an offer to contract, and should not be relied upon as such. Every project is different, and specific scope, pricing, materials, and timelines are determined only through a direct consultation and a signed written agreement with CM Custom Design.

Submitting a contact form, requesting a consultation, or otherwise communicating with us through the Site does not create a contractual relationship, and does not obligate CM Custom Design to perform any work, until a separate written agreement is signed by both parties.

5. Disclaimers

The Site and all content on it are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted, timely, secure, or error-free. Project photographs, renderings, and descriptions are illustrative and may not reflect the exact scope, materials, or outcome of any future project, which will vary by site conditions, client selections, and applicable code requirements. CM Custom Design does not warrant the accuracy, completeness, or currentness of any information on the Site.

6. Limitation of Liability

To the fullest extent permitted by applicable law, CM Custom Design and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or in connection with your access to or use of, or inability to access or use, the Site, even if we have been advised of the possibility of such damages. To the fullest extent permitted by applicable law, our total aggregate liability to you for any claim arising from or related to the Site shall not exceed one hundred dollars ($100).

It does not apply to, limit, or modify the separate terms, warranties, or liability provisions of any signed construction, renovation, design, or fabrication agreement between you and CM Custom Design, which are governed exclusively by that agreement.
